日本にもありますよね。日本の法律では、その上に無期懲役刑が存在します。

フィリピンでは死刑制度には歴史が多く、1980年代後半にアジア初の死刑制度廃止国になりましたが90年代前半には制度を復活させる法律を制定しています。2000年には制度の執行が停止され2006年に正式に制度は廃止されました。

しかし、現在の大統領であるドゥテルテ大統領は選挙戦においての誓約として死刑制度の復活を掲げていました。そして大統領となり、有言実行に移すべく特定のケースにおける死刑制度の再導入に関する法案を下院に提出し、審査が通り下院で可決されましたが上院では法案は否決されていました。

これほどまでに死刑制度が右往左往していますが、報道機関の調査によると国民の半数以上が死刑制度復活に肯定的な意見を持っています。

そんなフィリピンでの死刑制度の話題が今、再加熱しています。
事の発端は２０日にタルラック州パニキで起きた母子殺害事件。近隣住民が犯行の前後をビデオ撮影しており、問題はスムーズに進んでいきました。この事件は、警官が土地の所有権に関する揉め事で隣人の母子を射殺し、逃亡。数時間後に出頭したという事件です。犯人の警官ですが、昨年も殺人事件の被疑者になっており証拠不十分で釈放されました。そのような人物が銃を携帯していたことにも市民は不安を隠せません。

このような凶悪犯罪に対して、死刑復活を求める法案の上院による決定を再度求めるべきだという声が挙がっています。
現在フィリピンにおける重い刑罰は終身刑で、仮釈放の制度はありません。次に重い刑罰は仮釈放の可 能性のある有期刑で、懲役刑の他に罰金刑も存在します。
死刑制度復活反対派の意見として、犯罪抑止にならないという前例があることや文明都市としてのモラルが主張されています。

死刑制度は日本でも現在様々な論争が発生しています。人の生死を人が決めるって不思議ですよね。
何よりも犯罪がなくなることが１番。
フィリピンの死刑制度の行く末は今後も追っていきたいと思います。

Death penalty debate rekindled by Paniqui killings

The killing of a mother and son in Paniqui, Tarlac last Sunday reopens a debate about whether the Senate should approve a bill seeking to reinstate the death penalty for heinous crimes.

The call for a Senate decision was made by boxing icon and Senator Emmanuel D. Pacquiao, a death penalty advocate, following the daylight murder of Sonya Gregorio, 52, and her son, Frank Gregorio, 25, by Police Senior Master Sgt. Jonel Nuezca, 46.

Without batting an eyelash, Nuezca shot the mother and the son who are both unarmed. He was probably thinking that the law is weak and he could easily serve time in jail. That is why he did a very brutal act.

‘’That’s the same mindset prompts criminals to carry out even the most heinous of crimes. Criminals and law violators know that they could just serve time in jail even if they commit gruesome crimes. I hope the death penalty bill needs to be enacted into law as a fast and effective measure that would give justice to victims of heinous crimes.’’ he stressed.

I call upon our countrymen: Don’t condemn the whole police force for the act on Nuezca. I strongly believe that many in the Philippine National Police are upright and Nuezca is just one rotten egg.he added.

(Instead of condemning the police force, we should help the police so they would feel the love and care of Filipinos whom they serve. We should show them our trust so that they could repay us through their faithful service to the people.he added.
