フィリピン 賃料等に対してモラトリアム承認

上院委員会が災害などの緊急事態時の賃料の支払いと立ち退きに対してモラトリアム(支払い期限の延長等)を承認しました。

日常生活に必要な生活費まで失った市民がいる中で、今回の決断は将来的にも重要なものになってくると思われます。
近年フィリピンを襲う自然災害は強まっており、特に昨年の台風被害は甚大なものとなりました。

パンデミックの影響で職を失ったかと思えば台風の被害で家を失ったり、物価が高騰したり…
人によっては全ての影響を一身に受けた方もいるのではないでしょうか。

生活を続けていく上で必要不可欠な衣食住は保証されるべきですし、故意でない以上は賃料等のモラトリアムも必要な制度ですが、民事不介入、賃借人の保護を賃貸人に強制するやり方は大きな問題です。

この制度により賃貸契約を結んでいる賃借人としては猶予が与えられ救済にもなり得ますが、賃貸人からするとモラトリアムによって収入が無い時期が生まれてしまいます。
借主などの居住者や隔離措置で被害を被った労働者を対象に社会的影響を緩和するための補償は行われていますが、現在は貸主側の損益については追求されていません。

「社会的影響」というのならば、いち早く借主側だけではなく、貸主への何らかの補償の整備をお願いしたいです。

Senate panel OKs moratorium on rentals, evictions in times of calamities

The Senate Committee on Trade, Commerce and Entrepreneurship has approved the bill seeking to provide a moratorium on rental payments and evictions during emergencies and calamities.

Sen. Aquilino “Koko” Pimentel III, chair of the said panel, approved in particular Senate Bill No. 1525 or the Rental Payment and Eviction Moratorium During Disasters and Emergencies Act.

Sen. Manuel “Lito” Lapid, sponsor of the bill, welcomed the development citing the negative impact of the COVID-19 pandemic to those who are renting, especially in residential units.

“Maraming mga empleyado ang nawalan ng trabaho; maraming mga negosyo ang napilitang magsara or dili kaya’y magbawas ng kanilang produksyon. Sa gitna ng kagipitang ito, ang mga mahihirap nating kababayan ay nawalan ng pambayad at pangtustos sa mga pang araw-araw na pangangailangan (Many employees lost their jobs; many businesses were forced to close or lessen production. In the midst of this difficulty, we have citizens who lost money to pay for their everyday needs),” Lapid said.

“isang halimbawa nito ay ang kawalan o kakulangan sa pambayad sa buwanang renta. Mabuti na lamang na mayroong temporaryong moratorium ang ipinatupad sa ilalim ng Bayanihan 1 at Bayanihan 2 na ating isinulong dito sa Senado (One of this is their sudden inability to pay for rental fees. It’s a good thing this temporary moratorium on rental fees under the Bayanihan 1 and Bayanihan 2 that we are pushing here in the Senate),” he further said.

Lapid said passage of the measure into law will institutionalize the moratorium on residential rental payments and prevent forced evictions during a calamity or emergency in the future. The bill also gives the Department of Trade and Industry authority to extend the policy to micro-small and medium enterprises that are also affected by rental fees.
